The Consumer Court of Delhi: Protecting Consumer Rights

Jurisdiction of the Consumer Court of Delhi

Consumer Court Structure

The Consumer Court of Delhi consists of three levels – the District Consumer Disputes Redressal Forum, the State Consumer Disputes Redressal Commission, and the National Consumer Disputes Redressal Commission.

District Consumer Disputes Redressal Forum (DCDRF)

The DCDRF is the first level of the consumer court hierarchy. It has jurisdiction over cases where the value of goods or services claimed does not exceed Rs.20 lakh. The forum comprises of a President and two members who are either retired or serving district judges. Consumers can file their complaints directly to the DCDRF without any legal representation. The forum must dispose of the case within 90 days from the date of filing.

State Consumer Disputes Redressal Commission (SCDRC)

The SCDRC is the second level of the consumer court hierarchy. It has jurisdiction over cases where the value of goods or services claimed is more than Rs.20 lakh but does not exceed Rs.1 crore. The commission comprises of a President and two members who are either retired or serving high court judges. Consumers can file their complaints directly to the SCDRC if they are not satisfied with the decision of the DCDRF. The commission must dispose of the case within 90 days from the date of filing.

National Consumer Disputes Redressal Commission (NCDRC)

The NCDRC is the apex body of the consumer court system. It has jurisdiction over cases where the value of goods or services claimed is more than Rs.1 crore. The commission comprises of a President and two members who are either retired or serving Supreme Court judges. Consumers can file their complaints directly to the NCDRC if they are not satisfied with the decision of the SCDRC. The commission must dispose of the case within 90 days from the date of filing.

Filing a Consumer Complaint

Consumers can file a consumer complaint at the Consumer Court of Delhi either online or through registered post. The complaint must contain the following information:

  • Name and contact details of the complainant
  • Name and address of the opposite party(s)
  • Description of the goods or services purchased
  • Date and mode of transaction
  • The amount of compensation sought
  • Supporting documents and evidence
  • Details of previous attempts for redressal, if any

After receiving the complaint, the court will send a notice to the opposite party(s) and schedule a hearing. Both parties can present their case and the court will make a decision based on the evidence presented.
